Therefore, one’s suggested SpireStocks portfolio should not/can not be explicitly shared with other investors. 

Moreover, the systematic and automated suggested buy and sell triggers are again based on your subscription date and the amount of your indicated initial investment.  This SpireStock automatic and systematic feature buys more shares when the price is low (dips) and sells at a noteworthy gain.  Thus, once again sharing information with other users based on your initial investment and subscription date may not be beneficial and can be a detriment to another user regardless of your intentions.

Please also note that the suggested triggers to buy and sell are based on your initial investment to include the date.  The SpireStock suggestions are only as good and accurate as the timely actions taken by the individual investor to ensure that SpireStocks.com is appraised of accurate information from the individual investor.

The editing tool interface is designed for that purpose in the unlikely event that the individual investor is compelled to disregard or alter the SpireStocks.com suggestions.

In summary, SpireStocks suggested actions are intended for the individual paid subscriber and shall not be shared with any other user, whether they are a SpireStock.com subscriber or not.  The free trial is intended to reveal to the SpireStocks.com domain NEW visitor how easy the software is to use, and, yes, we realize that the FIRST time visitor, at the INITIAL visit will receive stock suggestions at a particular date and time and based on an amount input to setup the free trial.  However, the free trial is NOT intended for subscribers [especially investment advisers] or non-subscribers to periodically start a free trial under a fictitious person that is not them and receive an updated list of stocks on a random and or periodic basis.  Any subscriber or non-subscriber who is found to have violated these terms of service will immediately be terminated from SpireStocks with no refund even if the current subscription period has not yet been complete, and, if they acknowledge the violation; they can renew with a new subscription after having paid full priced subscriptions and starting anew from the day they re-initiate the new subscription.  This is not intended to discard the promotion of SpireStocks or the discussion with other subscribers, but suggested automated triggers should not be shared, since they may cause confusion or be detrimental to another user that could have slightly different suggested actions.

At any time during the subscription period, if your portfolio value is greater than or equal to $750K, SpireStocks.com will charge a 10% fee based on the gains of the portfolio calculated by taking ten percent of the gains of the average portfolio value during the last ten days before subscription expiration.  This fee is in addition to the regular software subscription fee and ONLY applies to portfolios which exceed or are equal to $750K in value at any time during the subscription period.  The additional fee will be due/payable no later than fourteen (14) days after the current subscription expiration date.  Repeat, this additional 10% fee of portfolio gain applies only to those portfolios’s that exceed or are equal to $750K in value at any time during the current subscription period and is in addition to the regular online software subscription fee.  As an example, lets say that the average portfolio value in the last ten days of expiration was exactly, $5M and the gains on the portfolio at expiration were 25%, or $1.25M.  The 10% fee of gains would then calculate to be $125K.

We reserve the right to modify these Terms of Service from time to time without notice. Please review these Terms of Service from time to time so that you will be apprised of any changes.

YOU UNDERSTAND AND AGREE THAT YOU DOWNLOAD OR OTHERWISE OBTAIN MATERIAL OR DATA THROUGH THE USE OF SPIRESTOCKS.COM AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA.

IN SUMMARY, SPIRESTOCK SUGGESTIONS ARE SUGGESTIONS, AND, ULTIMATELY EACH PERSON IS RESPONSIBLE FOR DECIDING TO ACT ON ANY SUGGESTIONS, AND, IN THIS CASE, THE SUGGESTIONS MUST BE ACTED ON THROUGH A REGISTERED/LICENSED BROKER FOR WHICH SPIRESTOCKS.COM IS NOT.

The Owners of SpireStock’s have an interest in the stocks suggested, since the owners utilize the SpireStock’s approach and methodology similar to the individual subscribers.  The reason is because SpireStocks.com works, as demonstrated by the demonstrated SpireStocks.com performance.

Without limiting the foregoing, under no circumstances shall SpireStocks.com be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.  The SpireStocks.com web-site is hosted by a separate entity on a separate server and SpireStocks.com shall not be responsible for any delayed service, as a result of delays and/or failed services provided by the company hosting the SpireStocks.com web-site.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by SpireStocks.com owners.
